MINISTERIO DE DESARROLLO ECONOMICO

<NOTA DE VIGENCIA: Derogado en su totalidad por las derogaciones parciales introducidas por los Decreto  1600 de 2005,  564 de 2006 y 1469 de 2010>

Por el cual se reglamentan las disposiciones referentes a licencias de construcción y urbanismo, al ejercicio de la curaduría urbana, y las sanciones urbanísticas.

EL PRESIDENTE DE LA REPUBLICA DE COLOMBIA,

en ejercicio de las facultades constitucionales y legales, especialmente  las que le confiere el numeral 11 del artículo 189 de la Constitución  Política, los artículos 48 y 67 de la Ley 9a. de 1989, los artículos  55, 58, 59, 60 y 61 del Decreto-ley 2150 de 1995, las  disposiciones contenidas en el Capítulo XI y el artículo 83 de la Ley 388  de 1997 y los artículos 2o., 6o., 8o., 9o., 10, 11, 15, 16,  

17, 18, 19, 24, 26, 30, 31 y 32 de la Ley 400 de 1997,

CONSIDERANDO:

Que el Gobierno Nacional expidió el Decreto 2111 de 1997, por el cual se reglamentó la materia de licencias de construcción y urbanismo, así como el régimen de los curadores urbanos y de las sanciones urbanísticas;

Que posteriormente se promulgó la Ley 400 de 1997, la cual modifica algunos aspectos relacionados con la expedición de las licencias de construcción, los curadores urbanos y las sanciones urbanísticas;

Que por la dinámica urbana se hace necesario reglamentar el artículo 48 de la Ley 9a. de 1989, en especial lo referente a la legalización de urbanizaciones y al reconocimiento de construcciones;

Que el numeral 4o. del artículo 101 de la Ley 388 de 1997, establece que el Gobierno Nacional reglamentará todo lo relacionado a cargo de los particulares que realicen trámites ante las curadurías urbanas, al igual que lo referente a la remuneración de quienes ejercen esta función teniendo en cuenta, entre otros, la cuantía y naturaleza de las obras que requieren licencia y las actuaciones que sean necesarias para expedirlas;

Que resulta conveniente expedir una reglamentación que armonice las modificaciones introducidas por la Ley 400 de 1997 con las disposiciones de la Ley 388 de 1997 referentes a las licencias, sanciones urbanísticas y curadores urbanos,
